Accident leads to DWI charge in New Jersey

When police come to the scene of an accident, they investigate and press charges if they believe a crime was committed. If they believe intoxication may have caused the car accident or incident, there may cause for them to file a DWI charge. A recent car accident along a New Jersey roadway resulted in a DWI charge against a driver involved in a single vehicle accident.

Around 3:30 a.m. on a Saturday, police responded to the scene of an accident. A man had been driving west in the eastern lanes of a roadway. He was alone in the vehicle, and the car overturned from the accident. At the time, police were not able to determine how long the man had been traveling the wrong way down the road or what exactly led to the accident.

He was found uninjured in the vehicle. He was also found to only be wearing boxer shorts. The man was accused of drunk driving, though it is unclear whether field sobriety breath tests were administered by the authorities at the scene.

Whenever a person is facing a DWI charge after a New Jersey motor vehicle accident, it may be difficult to conduct testing for blood alcohol content or to even ask questions of the driver. Nevertheless, this individual must necessarily focus on the formal accusations made against him and began to plan his criminal defense. In view of the potential consequences that could follow a conviction, the man will be well served to retain professional help. Together with his counsel, the factual allegations and criminal charges may be scrutinized with a view toward identifying possible areas of legal challenge as the case heads to court.
