Clinton challenges Supreme Court to overturn gay marriage ban

Bill Clinton has called on the U.S. Supreme Court to overturn legislation that he claims harms gay couples who want to marry. Although Clinton signed the Defense of Marriage Act in 1996 when he was president, he claims that family law challenges have shown that the law is obsolete and that it discriminates against same-sex partners.

A Washington Post opinion piece written by the former president says that society has changed since he signed the DMA into law. He also says that he only signed the act to prevent even more negative legislation against gays. He asks the Supreme Court to overturn the law and allow federal recognition of same-sex marriage, a move that could affect the Supreme Court's ruling on California's gay marriage ban.

The Supreme Court is expected to take up the issue of the constitutionality of the Defense of Marriage Act in the next few weeks. Proponents of gay marriage are watching to see how the highest court in the land rules while advocates of male-female marriages are also eager to hear the Supreme Court's ruling.

Although gay couples are currently not permitted to marry in most states, same-sex couples still face many of the same issues as married partners when they choose to dissolve their relationships, especially if the couple has adopted children. Family law attorneys may be able to help same-sex couples understand the laws that pertain to their relationships or domestic partnerships and work to reach agreements on how to divide property and settle child support and custody issues. Knowledgeable family law attorneys in New Jersey may work with same-sex couples to explain their rights and options within the state.
